《忻州市国土地上房屋征收与补偿规定》的 相关规定

一、被征收房屋建筑面积以房屋所有权证或房屋租赁证标注建筑面积为准。未标注建筑面积的,平房建筑面积按使用面积乘以1.334计算,楼房建筑面积以实测建筑面积为准。

二、对未经登记的建筑,房屋征收部门应组织规划、国土、财政、房管等部门进行认定。认定为合法建筑的,应予以补偿;认定为违法建筑的,不予补偿。

三、征收住宅房屋的,被征收人可选择货币补偿,也可选择房屋产权调换。征收非住宅房屋一律实行货币补偿。

四、征收私产房屋,按照评估价值给予补偿。

五、征收集体、私有企业占有的非出让国有土地上的房屋,房屋(包括装饰装潢)价值补偿原则上按照房屋评估价扣除土地出让价款确定并予以货币补偿。

六、违章建筑和超过批准期限的临时建筑,不予补偿。

七、征收私有住宅房屋,每户可在原建筑面积基础上无偿赠送10%的建筑面积,最高不超过15平方米,拆除面积不足45平方米的,安置到45平方米,不结算差价;超过45平方米的,按优惠价1500元/平方米安置到60平方米。被征收人要求再增加安置面积的,增加部分按市场价格购买。被征收人原选择“大房换小房”的,调换房屋不足原房屋面积部分,按照被征收房屋相似房地产的市场价格结算差价。被征收人按照搬迁先后顺序选择安置房。

八、征收住宅房屋应给予搬迁补助。忻州市区搬迁补助费按房屋建筑面积(不含地下室等附属用房)15元/平方米计算,不足600元的按600元支付。期房安置的,搬迁补助费按两次计算,一次付清

九、征收住宅房屋应给予临时安置补助。忻州市区被征收人自行过渡的,临时安置费按被征收房屋建筑面积15元/平方米·月计算,不足800元/月的按800元/月支付。提供周转房的,被征收人不享受临时安置补偿。

十、征收非住宅房屋应给予搬迁补助。忻州市区商业营业(含仓储)用房每平方米不超过60元,生产用房每平方米不超过80元,办公用房每平方米不超过40元,医疗文化教育用房每平方米不超过60元

十一、忻州市区被征收人选择产权调换,在征收决定下达后20天内搬迁完毕的,按3万元/户标准予以奖励;21天至25天搬迁完毕的,按2万元/户标准予以奖励;26天至30天搬迁完毕的,按1万元/户标准予以奖励;超过30天未搬迁完毕的,不予奖励。

十二、低层和多层安置房屋的过渡期限不得超过2年,中高层和高层安置房屋的过渡期限不得超过3年。征收住宅房屋,被征收人选择产权调换方式补偿的,在等待期房安置过渡期间,房屋征收部门应当支付其自搬迁之月起至用于产权调换房屋交付后六个月内的临时补助费。

十三、临时安置补助费自被征收人搬迁之日起按月计算,首次发放期为12个月,其后每6个月发放一次。

十四、在通知办理安置房屋入住手续期限内,被征收人不办理入住手续的,停止发放临时安置补助费
